Character considerations

In considering an application for assistance, section 33 of the FAS Act requires the FAS to take into account the character, behaviour and attitude of the applicant at any time, whether before, during or after the act of violence. The FAS will also apply these factors to the deceased primary victim, in the case of an application by a related victim.

In considering the character and behaviour of the applicant or deceased primary victim, the past criminal history and the number and nature of any findings of guilt or convictions are considered, if the FAS considers these relevant. It is anticipated that, like under the VOCAT scheme, the FAS would consider serious and more recent offending involving violence or dishonesty to be particularly relevant.
